Eric, you grossly misread the case and the issues at hand. The school did not object to the negative reviews, under the guise of a "reviews" website. The individual web host, Jessie Nickles, fabricated content, posted content he knew to be false with the intention of damaging the University (see Court minutes of testimony), repeatedly harassed individuals of the University, called private phone numbers to threaten University staff, and even attempted to profit directly from his harassment by sending demands for payment from the University in order to discontinue his disparagement.

This is an extortion case where the defendant did not even bother to appear or respond to court requests (as a private individual OR a corporation), and continued to post egregious (intentionally untrue) disparaging comments not as a review host, but as a private individual and business entity - to the extent of posting NUDE photos of a reporter's child online.

Please visit the defendant's Twitter page going back to 2009 to review the REAL facts before posting such a poorly developed argument in defense of ongoing cyber stalking, harassment, threats of intentional harm to members of the University community, and extortion.

Yes, and if this had been a contested proceeding, that issue would have surely surfaced. However, I note that for colleges, the marginal cost of one additional student is typically near-zero; though a cohort of 12 surely required some additional marginal infrastructure. Eric.

RE: "Neumont claims it lost at least 12 matriculants due to Collegetimes, resulting in $1.02M of lost revenues ($85k/student)."

Shouldn't lost profit determine the size of the award, not lost revenue?

Thanks for the analysis Eric. Quite puzzling that a business owner would choose to default resulting in a certain $1M in liabilities over the cost of ANY qualified lawyer. It sounds like even somebody with only a few years indirect experience could have done a substantially better job defending this one.
