In Modernizing Common Carrier Rules, Report and Order, 32 FCC Rcd. 968 (2017) (WC Docket No. 15-33), 2017 WL 4023987 (removing obsolete telegraph-related regulations from Title II and the CFR), the FCC declared it would no longer regulate a telegraph but did not declare FCC-unregulatable a service that is functionally equivalent to a telegraph service.
