I think the plaintiff was arguing that Pinterest sometimes directly encoded an image in an email without the use of HTML. If Pinterest directly encoded a PDF in an email, and the PDF included a copyrighted image, Pinterest might have difficulty in detecting possible copyright infringement without a takedown notice. Of course, if the email or alert has already been sent, the infringement has already taken place.]]></description>
