No, you didn't. You didn't even try to hear from him or get his perspective. Of note, his trial attorney failed him in two important aspects — copyright and access, both of which would have led to a positive decision on discovery from the district judge instead of a denial. Before you pen an article like this, please do your homework before pre-judging a case based on faulty decisions by appellate judges.
