					<description><![CDATA[The plaintiff is absolutely a copyright troll, in the lineage of AdLife, Leibowitz, Higbee, et al.  The strategy is clear, put a bunch of photos on the internet, purport to &quot;license&quot; them for exorbitant sums but don&#039;t actually sell them to anyone, and then use TinEye to find extortion victims I mean dastardly infringers. I don&#039;t know if these are the same photos that AdLife actually gave away for free before deciding to be a troll.  But I would love to take discovery in one of these cases.

Hunley only reiterated what Perfect 10 had established, and the rationale of Perfect 10 was expressly rejected by Goldman and the other NY district court decisions that favor the incorporation test over the server test, so I don&#039;t think it really moves the needle on persuasion outside the Ninth Circuit or otherwise depracates Goldman. We just have a bubbling circuit split that the Second Circuit needs to either confirm or deny.]]></description>
