In reply to Paul Sturm. Suppose that turns out to be possible. All it would mean is that the team of the prompt engineer and the LLM has composed a derivative work. Which is not at all the same thing as the LLM being itself a derivative work.

What if you prompted the LLM with “Please produce a derivative work of such-and-such”? And/or could the plaintiffs engineer some prompt that reliably produces a derivative work of a specified target? “Tell me a story following the general outline of such-and-such but with the names changed.”
