@Eri@Eric_Goldman:disqus , given your strong opinions on this draft bill, I'd love to hear how you would meaningfully tackle the significant issue of counterfeit goods being sold online, specifically via online marketplaces that have a pervasive counterfeit problem and have not done enough to address it, resulting in harm not just to consumers and to IP owners, but also to legitimate sellers on those platforms.

Your analysis of this draft bill raises a number of legitimate concerns.

So, if given the pen, how would you address the underlying issue, if not via this bill's specific provisions? You mention balance, so what exactly would balance look like?

Your comment makes me wonder if you actually read the 5,000 words preceding it? The Q isn't ONLY whether vetting third-party sellers and the stuff they sell is a good idea. The Q is how the ecosystem will respond to this bill. I spend 5,000 words explaining why this bill doesn't appropriately BALANCE the various interests. Indeed, the bill only benefits some trademark owners who want online marketplaces shut down, so it would be great to get explanations why that "good thing" justifies all of the other terrible and devastating impacts the bill will produce.

Yeah, Eric and other people I’ve seen up in arms over this bill don’t seem to understand why this is such a big issue. Nor do they seem to understand why vetting third-party sellers and the stuff they sell would be a good thing.
