Yes, there could be a publicity rights violation even if the copyrights aren’t being infringed. I doubt a non-profit organization’s editorial publication of photos to document its event would constitute a commercial use sufficient to trigger the publicity rights, however.

Does a subject’s publicity rights trump an author’s copyright in an image?
