From experience as in-house counsel at MySpace a dozen years ago, then-AG Blumenthal was leader of the bulldog pack. The issue of the day was keeping sexual predators from using online social networks, of which ours was the largest. Never mind that we were adding 300,000 new registered users *per day*; we were expected to somehow magically (1) screen out registered sex offenders, when the only identifiers we had for new users were screen name and email address; and (2) keep children under 13 from lying about their birthdates to circumvent COPPA.

It seems like the lesser evil than letting 50 state's legislatures run roughshod over the CDA. Unfortunately, many of these Senators are former state attorneys, so calling their peers' motivations and qualifications into question is counterproductive. Just like when most of them exited stage left after they got in their sound bites and it was time for the anti-SESTA witnesses to speak.

During the hearing, there was some discussion of the Mann Act and how Congress had authorized the DOJ to deputize state's attorneys general to prosecute under that federal criminal statute. Would it not be a much more elegant and practical solution to do the same with the other specific federal statutes that address human trafficking, rather than unraveling the CDA and returning the internet to the Stratton Oakmont era? After all, that's effectively the end result that the state AGs are seeking.
