There is a guideline called circular 21 distributed by the copyright office. It addresses what the educational use can be and what it cannot be. In this case, the student was no longer a student and Flickr is a sharing app and not a storage medium which is obviously open to public viewing. Educational use does not apply outside the classroom. The school also used Reiner’s image and the images of other photographers in violation of the guidelines setup by the copyright office. I think this needs further scrutiny.
