After reading the recent Goldman Sachs report that the rift will lose next to sony psvr and htc vive, coupled with the fact Marc andreeson dumped most of his Facebook stock recently, it seems oculus day is done. A shame that the vr dream team at oculus failed with a 2 billion dollar capital injection. I agree with this blog post, it's a damn shame that palmer signed so many rights away to trt and zenimax in very broad terms. Couldn't palmer afford better lawyers? Perhaps if more clear legal agreements had been signed in the early days, instead of valve, zenimax, trt, htc, oculus all seeming enemies now,, they could be working together as friends. But now because there was legal confusion, lots of bad blood and infighting that doesn't really help the industry as a whole. Instead this may have handed the crown to sony psvr this round, and oculus was very worried about sony spoiling the well if they won this round, hurting the whole industry. If only good clear legal issues were solved early with good contracts, the industry might be very different today. Valve, trt, vive, oculus, zenimax all working together for the industry as a whole, sharing technology, standards, etc instead of this bitter mess we have now. Last I heard zenimax was trying to get their case heard in Texas instead of California so that the nda terms were more enforceable and not as easily dismissed as they would be in california. Not sure why trt attorneys can't do that too, but regardless, this all could have been avoided if palmer had gotten good attorneys early, what incompetence.

Oh, which court ruled that "the Rift" is precisely the device you specify and no other? Will you change your story once the next Rift comes out that *that* device is "the Rift" and not the CV1? How about the one after that? Obviously you're the arbiter of what devices are and are not Rifts and you should be hired by Oculus and paid millions just to sit at a desk and say "now *this* thing is the Rift", because nobody else has that power.

The dk1 is not the rift. The rift ships march 28 2016 and is not open source. And it was not open source at the time of the kickstarter as promised, but made open source much later. After some of us lost business contracts that incorporated an open source dk1 in 2012 that was not delivered. Long after palmer secured his mega bucks did the open source the dk1, long after I had lost my contracts believing palmers lie.

Palmer did promise an open source hmd, but the day before the kickstarter he changed the terms and lied. So it seems the Skype conversation where he gets out of trouble based on "open source" can be disregarded and trt can hurt palmer. If only he had kept his open source promise. Instead he lied about open source and therefore intended to profit from the design and trt can nail him on theft.
