I'm sorry to hear about bad experiences. However, I still don't see how any of this relates to the Consumer Review Freedom Act, because the problems you describe would not be fixed by contractually banning customers from posting reviews. Eric.

I owned a business and was very conscientious. We had many good online reviews, but some that were false, or smear jobs, which we were usually able to pinpoint to a customer who tried to take advantage of us but couldn't, or got caught stealing and told not to return. So they got revenge online. One even falsely accused my husband of being a criminal. The review sites are uniformly reluctant to remove such content: one popular review site won't take them down unless the merchant "joins" and pays a monthly fee.

There is no doubt that these reviews hurt our business, but they hurt our morale, too. The ferocity with which people defend consumers and attack businesses who are concerned about false reviews never ceases to amaze us. Even here, this blog entry states "so it will not be easy for a business to skirt around this law" which sums up the author's attitude, and that of the consumers, that consumers are good, business owners bad. Reminds me of another slogan with similar merit that reads: "Four legs good, two legs bad."

Eventually we closed the business early. Of course, there were many factors that went into this decision. One of them was having to deal with that part of humanity that wants to tear down, and those who support them against all reason.

I would suggest the following two paragraphs.

Clauses of contracts or agreements seeking to silence the consumer from reviewing services or products provided in any way or seeking to limit access to United States Seventh Amendment jury trials in any way except jurisdictional choice are null and void.

Furthermore; Contracts or agreements seeking to silence consumers from reviewing
services or products provided in any way or seeking to limit access to United States Seventh Amendment jury trials are liable for punitive damages for fraud, if these are not noted and affirmed separately. Any authoritative American English dictionary word definition may be used for these two paragraphs.
