Nice analysis, but you forgot one of the biggest reasons to ignore the notice -- the fair report privilege. See Nieman v. Versuslaw Inc., 2012 WL 3201931 (C.D.Ill. 2012) (aff’d 512 Fed.Appx. 635 (7th Cir. 2013)); see also https://blog.ericgoldman.org/archives/2013/03/first_amendment_1.htm

I frequently get junk notices like this for TheDirty.com, usually from sites that charge $200 to help someone send a DMCA notice. These sites infuriate me. First, they are practicing law without a license. Second, they charge a significant fee but the customer does 99% of the work; the only thing the service provider does is forward an email containing information they've obtained from the customer.

I usually respond to these services by explaining that we will not even consider the matter unless they refund the amount charged to their customer and the customer provides proof that they got their money back. On at least a few occasions this has worked.
