					<description><![CDATA[I have just read a blog post on UK Trademark law and it seems that &#039;initial interest confusion&#039; is also dying in the UK. In Interflora v. Mark &#038; Spencer, a Court of Appeal found that the initial interest confusion doctrine is misleading and does not comport with the test laid down by the CJEU.

I am not sure how the Continental European countries think about this doctrine. But my first guess was that they would favor it because it prevents the like of Google from making money from someone else IP (trademark/keyword) for free. It turns out that trademark doctrine is probably not as strong as copyright/moral rights in Europe. Trademark, after all, is completely commercial in nature and doesn&#039;t have &#039;moral&#039; aspect as copyright law.]]></description>
