					<description><![CDATA[One question I have if anyone is monitoring this space. In the New York case I believe that it was said that Sirius had won one small victory in that the statute of limitations for those who had a claim against Sirius XM was lowered to three years instead of the six years the Judge had contemplated. 

No one mentions the statute of limitations much. Does this limit all parties suing Sirius XM for infringement of their performance rights to have to have had the alleged offense occur within three years of the filing of the lawsuit, or is there some right to a suspension of the statute of limitations under these conditions.

To clarify, if a record label sued Sirius for non-payment of hundreds of thousands of dollars of performance royalty fees between the years 1990 and 1995, is the suit untimely because it was not filed by 1998?]]></description>

I would refer this to anyone who wanted to understand these cases and their ramifications. The general media accounts are just so shallow. They all seem to think that a federal trial judge is going to have the last word on defining California state copyright law pre-1972.]]></description>
