I know this is an old article but why do you list Linden Research as a defendant in your title and the Case Citation link? There is no reference to them as a defendant in this case.

Actually, the behavior in this case is typical, what is unusual is that someone actually sued over it. The whole issue of third party content is a hot bed of discontent in the video gaming world at the present. Content hosters (like Second Life) have been changing their TOS trying to get a better handle on it but they are caught between a rock and a hard place.

The underlying situation is that content in the video game world is moving away from a producer-centered model to a community-centered model (like Steam Workshop). This is sometimes called "player created content". The difficulty is that unlike a producer centered model where there are teams of lawyers vetting everything, most work in player-centered content creation is done informally. As a thought experiment, imagine a world where Industrial Revolution was reversed and everyone went back to "piece work" again. As a consequence the chain of ownership is unclear, someone gets their feeling hurt or they feel that their goodwill has been abused ,and then war erupts.

In other words, expect to see more of these types of cases as the years progress because this is the way the video game industry is heading.
